தேர்தல் பார்வையாளர் ரமேஷ்குமார் சுதான்சு மீது நடவடிக்கை

இந்திய தேர்தல் ஆணையத்திடம் வைகோ புகார்!

சங்கரன்கோயில் சட்டமன்ற இடைத்தேர்தலில் வாக்காளர்களுக்கு அண்ணா தி.மு.க. பணம் கொடுத்த அப்பட்டமான தேர்தல் குற்றத்தை மறுத்து, ஊழலுக்குத் துணைபோன தேர்தல் பார்வையாளர் ரமேஷ்குமார்
சுதான்சு மீது இந்திய தேர்தல் ஆணையத்திடம் நடவடிக்கை எடுக்கக் கோரி வைகோ புகார்:

இன்று 19.03.2012 இந்தியத் தலைமைத் தேர்தல் ஆணையர் குரேஷி அவர்களுக்கும் இந்திய தேர்தல் ஆணையர் சம்பத் அவர்களுக்கும் மறுமலர்ச்சி திராவிட முன்னேற்றக் கழகப் பொதுச்செயலாளர் வைகோ அவர்கள் மின் அஞ்சல் மூலமும், தொலைநகல் மூலமும் பின்வருமாறு புகார் அனுப்பியுள்ளார்.



சங்கரன்கோயில் சட்டமன்ற இடைத்தேர்தலில் ஆளும் கட்சியான அண்ணா தி.மு.க.வின் அமைச்சர்களும், கட்சி நிர்வாகிகளும் ஒரு வாக்காளருக்கு
ரூ.1,000/- வீதம் தொகுதி முழுவதும் அனைவருக்கும் மார்ச் 15,16 தேதிகளில் பணம் கொடுத்தனர் என்பதை, மார்ச் 16 ஆம் தேதி அன்று இந்தியத் தேர்தல் ஆணையத்திற்கு நடவடிக்கை எடுக்கக்கோரி புகார் அனுப்பியிருந்தேன். மார்ச் 15 ஆம் தேதி இரவில் மறுமலர்ச்சி தி.மு.க. வேட்பாளர் டாக்டர் சதன்
திருமலைக்குமார் அவர்களும், நானும் தேர்தல் பார்வையாளர் ரமேஷ்குமார் சுதான்சுவை தொடர்புகொள்ள எவ்வளவோ முயற்சித்தோம். அவரது அலைபேசி அணைக்கப்பட்டிருந்தது. அவர் எங்கிருக்கிறார் என்பதையும்
அறிய முடியவில்லை. மார்ச் 16 ஆம் தேதி காலையில் தொலைநகல் மூலமும், நேரடியாவும் வாக்காளர்களுக்கு பணப் பட்டுவாடா செய்யப் பட்டிருந்ததைப் புகாராகத் தெரிவித்திருந்தோம். மார்ச் 16 ஆம் தேதி காலை 8 மணி அளவில் எனது சொந்த கிராமமான கலிங்கப்பட்டியில் அண்ணா தி.மு.க.வினர் வாக்காளர்களுக்கு பணம் கொடுத்துக் கொண்டிருந்தபோது, பொதுமக்களால் கையும் களவுமாகப் பிடிக்கப்பட்டு, அவர்கள் வந்த
வாகனங்களுடன் காவல்துறையினரிடம் ஒப்படைக்கப்பட்டனர்.

இதுகுறித்து கரிவலம்வந்தநல்லூர் காவல் நிலையத்தில் புகார் கொடுக்கப்பட்டு, புகாரும் பதிவு செய்யப்பட்டுள்ளது. இந்த நிலையில் மார்ச் 18 ஆம் தேதி வாக்குப்பதிவு அன்று பிற்பகலில் தேர்தல் பார்வையாளர் ரமேஷ்குமார் சுதான்சுவும், தேர்தல் ஆணையத்தின் காவல்துறை பார்வையாளர் விஜயராஜ்சிங் கெளதமும் கலிங்கப்பட்டி வாக்குச் சாவடிகளைப் பார்வையிட்டனர்.

பத்திரிகையாளர்களிடம் தேர்தல் பார்வையாளர் ரமேஷ்குமார் சுதான்சு பணப் பட்டுவாடா குறித்து தனக்கு எந்தப் புகாரும் வரவில்லை என்றும், தொகுதியில் வாக்காளர்களுக்கு எந்த இடத்திலும் பணம் கொடுத்ததாகத்
தெரியவில்லை என்றும் கூறியிருப்பது மிகுந்த அதிர்ச்சி அளிக்கிறது.

இதிலிருந்து ஒன்று தெளிவாகப் புரிகிறது. தேர்தல் சட்டத்தின்படி தண்டனைக்குள்ளாகும் சட்ட மீறல்களை வாக்காளர்களுக்குப் பணம் கொடுத்து விதிமுறையை அப்பட்டமாக மீறியதைத் தேர்தல் பார்வையாளர்
ரமேஷ்குமார் சுதான்சுவின் முழு ஒத்துழைப்போடுதான் அண்ணா தி.மு.க., செய்திருக்கிறது என்பதை எவரும் புரிந்துகொள்ளலாம்.

தேர்தல் பார்வையாளர் கூறியிருப்பது ஜனநாயகத்தின் மீது மக்களுக்கு உள்ள நம்பிக்கையை ஆட்டம்காணச் செய்துவிட்டது. தேர்தல் பார்வையாளரின் சட்டவிரோதமான - கண்டனத்திற்குரிய நடவடிக்கைகள் தேர்தல்
ஆணையத்தின் நம்பகத்தன்மையையும், மதிப்பையும் வெகுவாகப் பாதிக்கும். இந்தியாவில் தேர்தல்கள் நேர்மையாகவும், சுதந்திரமாகவும் நடத்துவதற்கு நடவடிக்கைகள் மேற்கொண்டுவரும் இந்தியத் தேர்தல் ஆணையம் மேற் கூறிய பிரச்சினையில் தேர்தல் பார்வையாளர் மீது உரிய நடவடிக்கை எடுக்க வேண்டுகிறேன்.

இவ்வாறு வைகோ தனது புகார் கடிதத்தில் தெரிவித்துள்ளார்.

Sub: Tamil Nadu- Bye-Election -219, Sankarankovil Assembly Constituency- Bribing of Electorate by the ruling party - The disturbing statement of the Election Observer - Reg.

I have already sent a representation to the Election Commission of India on 16th March 2012 in which I brought to the notice of the Election Commission about the distribution of money Rs.1000 per vote throughout the constituency by the AIADMK ministers and functionaries. This is a serious offence under the election law. You were so kind enough to assure me to look into the matter and take appropriate steps.

On 15th night MDMK candidtate Dr.T. Sadhan Thirumalaikumar and I tried to contact the election observer Mr. Ramesh Kumar Sudhanshu, but his mobile phone was switched off and his whereabouts could not be traced. On 16th morning I have sent a letter to him by fax and also in person regarding the distribution of money to the electorate. On 16th morning by 8 a.m the AIADMK functionaries were caught red handed in my native village Kalingapatti when they were distributing money to the voters and they were handed over to the police and the seized vehicles were also handed over to the police. A complaint was made with the police
in the Karivalamvandhanallur police station in this regard.

Election observer Mr. Ramesh Kumar Sudhanshu and Police observer Mr. Vijayraj Singh Gautam visited the polling booths at Kalingapatti on 18th afternoon. It is terribly shocking that the election observer Mr. Ramesh Kumar Sudhanshu made a statement to the press after visiting the Kalingapatti polling booths that he did not receive any complaint about bribing of the electorate with money and no distribution of money to the electorate took place in the constituency.

It could be presumed that the gross violation of model code of conduct and the offence of bribing of voters punishable under the election law committed by the ruling AIADMK party has been carried out in total connivance with the election observer Mr. Ramesh Kumar Sudhanshu. This statement has totally shaken the confidence of the people in democracy. This sort of condemnable attitude and activities of such election observer will affect the reputation and credibility of the Election Commission, which is taking all earnest steps to conduct free
and fair poll throughout the country.

I would request you to take necessary steps against the Election Observer to ensure the confidence of the people in the Election Commission in this matter.
